Polish law regulations concerning competence management in the time of crisis or armed conflict are as follows:
- Ustawa z dnia 21.11.1967 r. o powszechnym obowiązku obrony RP - Act of 21 November 1967 on universal duty to defend the Republic of Poland.
- Ustawa z dnia 23.08.2001 r. o organizowaniu zadań na rzecz obronności państwa realizowanych przez przedsiębiorców - Act of 23 August 2001 on organisation of tasks for national defence carried out by entrepreneurs.
- Ustawa o stanie klęski żywiołowej z dnia 18.04.2002 r. - Act of 18 April 2002 on state of natural disaster - specifies the conditions for implementing extraordinary measures in case of disasters, which may be either natural or human-made; defines circumstances and rules of declaring / calling off the natural disaster plan; defines duties of the governmental institutions in such cases.
- Ustawa o stanie wyjątkowym z dnia 26.04.2002 r. - Act of 26 April 2002 on state of emergency - defines circumstances and rules of declaring / calling off the state of emergency; defines duties and obligations of the governmental institutions in such circumstances.
- Ustawa o stanie wojennym oraz o kompetencjach Naczelnego Dowódcy Sił Zbrojnych
i zasadach jego podległości konstytucyjnym organom RP z dnia 29.08.2002 r. - Martial Law Act and Act of 29 August 2002 on the Polish Armed Forces Supreme Commander’s competence and his subordination to the state’s constitutional authorities - conditions and procedures of declaring / calling off the martial law, code of conduct for governmental authorities, rules of suspending and limiting human rights and freedoms during the martial law. Moreover, the act allows to impose on entrepreneurs additional tasks essential for state’s security or defence reasons. Receivership may be imposed over the companies or obligation of compulsory deliveries for certain producers of agricultural and other goods imposed on citizens and companies. - Ustawa z dnia 26.04.2007 r. o zarządzaniu kryzysowym - Act of 26 April 2007 on crisis management - provides information on governmental institutions responsible for crisis management, their duties and code of conduct in this matters; provides also information on financial sources for tasks related to crisis management issues.
- Ustawa z dnia 29.10.2010 r. o rezerwach strategicznych - Act of 29 October 2010 on strategic reserves - defines rules of creating, maintaining, sparing, liquidation and financing of national strategic reserves. Such reserves are created in case of threats against national security and defence, public order and health, natural calamities or crisis situations. Strategic reserves may include: natural resources, materials, machinery, equipment, critical infrastructure elements, fuel, agricultural goods, medical goods.

Decyzja Ministra Obrony Narodowej z dnia 7 lutego 2011 r. w sprawie system pozyskiwania, eksploatacji i wycofywania uzbrojenia i sprzętu wojskowego Sił Zbrojnych RP - Decision of Minister of National Defence No. 28/MON dated 7 February 2011 related to acquisition, exploitation and withdrawal system of Polish military equipment.

1 February 2011 on list of military units requiring permit to become a subject to trade; - Rozporządzenie Ministra Gospodarki i Pracy z dnia 13 września 2004 r. w sprawie zakresu informacji przekazywanych organowi kontroli obrotu przez osoby fizyczne lub prawne dokonujące obrotu towarami o znaczeniu strategicznym w ramach zezwoleń generalnych - Ordinance of the Minister of Economy and Labour dated 13 September 2004 on scope of information required by authorities form entrepreneurs involved in trade of goods of strategic importance;
- Rozporządzenie Ministra Gospodarki i Pracy z dnia 28 września 2004 r. w sprawie wzorów zezwoleń indywidualnych lub globalnych na obrót towarami o znaczeniu strategicznym oraz wzoru certyfikatu importowego - Ordinance of the Minister of Economy and Labour of 28 September 2004 on permits required for trade in goods of strategic importance;
- Rozporządzenie Ministra Gospodarki i Pracy z dnia 1 października 2004 r. w sprawie sposobu prowadzenia ewidencji obrotu towarami o znaczeniu strategicznym - Ordinance of the Minister of Economy and Labour dated 1 October 2004 on maintaining register of goods of strategic importance;
- Rozporządzenie Rady Ministrów z dnia 4 października 2010 r. w sprawie wykazu spółek, przedsiębiorstw państwowych i jednostek badawczo-rozwojowych prowadzących działalność na potrzeby bezpieczeństwa i obronności państwa, a także spółek realizujących obrót z zagranicą towarami, technologiami i usługami o znaczeniu strategicznym dla bezpieczeństwa państwa oraz dla utrzymania międzynarodowego pokoju i bezpieczeństwa - Ordinance of Ministers Board of 4 October 2010 on register of state companies and units conducting scientific research for the purposes of national security and defence, and companies involved in foreign trade in goods, technology and services of strategic importance for national security and keeping international peace and security.

Objectives of the national SoS policy
- to ensure that industrial resources needed to meet critical and urgent defense requirements are provided in a timely, effective an efficient manner;

The role of SoS in Procurement procedures (requirements, evaluation etc.)
Transposition of Defence Procurement Directive 2009/81/EC into national law, makes it possible to assess and require SoS guaranties in procurement procedures:

Contractual terms on SoS
In general, public procurement in Poland is done according to Act of 29 January 2004 Public Procurement Law (ustawa z dnia 29 stycznia 2004 r. – Prawo zamówień publicznych). However, based on the Article 346 of the TFEU, Article 4 of the Act states that the Public Procurement Law shall not be applied to contracts where the object of the contract includes armaments within the meaning of the Act of 29 November 2000 on foreign trade in goods, technologies and services of strategic significance for state security and for keeping international peace and security (Ustawa z dnia 29 listopada 2000 r. o obrocie z zagranicą towarami, technologiami i usługami o znaczeniu strategicznym dla bezpieczeństwa państwa, a także dla utrzymania międzynarodowego pokoju
i bezpieczeństwa).
The main principles of Minister of National Defence Decision No. 291/MON dated 26 July 2006 on principles and procedures related to creating contracts on armaments and military equipment (Decyzja Ministra Obrony Narodowej Nr 291/MON z dnia 26 lipca 2006 r. w sprawie zasad i trybu zawierania w resorcie obrony narodowej, umów których przedmiotem jest UiSW) state that the procurement procedures should be conducted legally, cost efficiently and go along with the guidelines or regulations considering:
- security of classified information;
- budget planning and execution;
- military scientific research;
- military R&D and new equipment testing;
- acceptance of military technical documentation;
- implementation of new armament;
- product assessment and certification;
- quality assurance management;
- codification standards;
- technical inspection;
- weather proof requirements;
- environmental management standards;
- offset requirements;
- custom duty exemptions;
- The Code of Conduct in Defence Procurement;
- The Code of Best Practices in the Supply Chain.
National policy on sharing information on stocks/inventories
Information required on other basis than rules of NATO agreements are considered on a case by case basis.
